1 Who We Are

4 Legal Basis for Processing
fachai3 processes your personal data only where there is a valid legal basis to do so under the Data Privacy Act of 2012 (RA 10173) and applicable PAGCOR regulations. The applicable legal bases are as follows:
- Contractual Necessity: Processing required to perform our obligations under the Terms and Conditions you agreed to when registering your fachai3 account — including account management, transaction processing, and game provision.
- Legal Obligation: Processing required to comply with Philippine laws and PAGCOR regulations, including KYC/AML obligations, tax reporting requirements, and data retention mandates.
- Legitimate Interests: Processing necessary for fachai3's legitimate business interests, including fraud prevention, platform security, responsible gaming monitoring, and product development — provided these interests are not overridden by your privacy rights.
- Consent: For specific processing activities not covered by the above bases — such as sending you promotional communications about new games or offers — fachai3 will rely on your freely given, specific, and informed consent, which you may withdraw at any time.
5 How We Use Your Data

6 Data Sharing & Disclosure
fachai3 does not sell your personal data. We share your data only in the following limited circumstances, and only to the extent necessary for the stated purpose:
- Payment Service Providers: GCash, PayMaya, BPI, BDO, Metrobank, and other payment partners receive the minimum data necessary to process your transactions securely.
- KYC & Identity Verification Partners: Third-party document verification providers who assist fachai3 in meeting its PAGCOR-mandated identity verification obligations. All such providers are contractually bound to handle your data in accordance with RA 10173.
- Technology Service Providers: Cloud hosting, database management, cybersecurity, and platform infrastructure providers operating under strict data processing agreements with fachai3.
- Regulatory Authorities: PAGCOR, the Anti-Money Laundering Council (AMLC), the National Privacy Commission (NPC), and other competent Philippine government authorities, where disclosure is required by law or in response to a lawful directive.
- Legal & Compliance Advisors: External legal counsel or compliance consultants under professional confidentiality obligations, where required to protect fachai3's legal rights or to comply with applicable law.
- Business Transfers: In the event of a merger, acquisition, or asset sale affecting fachai3, your personal data may be transferred to the acquiring entity, subject to the same privacy protections as described in this Policy. Registered players will be notified of any such transfer in advance.
7 Cookies & Tracking Technologies
fachai3 uses cookies and similar tracking technologies to operate the platform efficiently, maintain your logged-in session, and gather anonymised analytics that help us improve the user experience for Filipino players.

8 Data Retention

The following general retention periods apply:
- Account & KYC Data: Retained for a minimum of five (5) years from the date of account closure or last account activity, as required under PAGCOR licensing conditions and AML record-keeping obligations.
- Transaction Records: Retained for a minimum of five (5) years from the date of the transaction, in compliance with AML regulations and tax reporting requirements.
- Customer Support Records: Retained for three (3) years from the date of the interaction, or longer if the matter relates to an active dispute or legal claim.
- Technical & Log Data: Retained for up to twelve (12) months, unless required to be retained longer for security investigations or fraud prevention purposes.
- Marketing Consent Records: Retained for as long as you maintain an active fachai3 account and for three (3) years thereafter, as evidence of consent or withdrawal of consent.
Upon expiry of the applicable retention period, fachai3 will securely delete or anonymise your personal data in accordance with our internal data disposal procedures.
9 Data Security
fachai3 implements a comprehensive set of technical and organisational security measures to protect your personal data against unauthorised access, accidental loss, destruction, or disclosure. These measures include:
- Transport Layer Security (TLS/SSL) encryption for all data in transit between your browser/app and the fachai3 servers;

10 Your Data Rights

Right to Restrict Processing
In certain circumstances — such as while a rectification request is being assessed, or where you have objected to processing — you may request that fachai3 restrict the processing of your data to storage only until the matter is resolved.
Right to Lodge a Complaint
If you believe fachai3 has not handled your personal data in accordance with RA 10173, you have the right to lodge a complaint with the National Privacy Commission (NPC) of the Philippines. We encourage you to contact us first so we can address your concern directly.
11 Children & Minors
The fachai3 platform is strictly restricted to individuals aged 21 years and above, in accordance with PAGCOR's age verification requirements for online gaming in the Philippines. fachai3 does not knowingly collect personal data from individuals under the age of 21.
If fachai3 discovers or has reasonable grounds to believe that a player is under the age of 21, the account will be immediately suspended, all gameplay data and balances will be reviewed, any winnings will be forfeited, deposited funds will be returned to the originating payment method (net of any applicable processing fees), and the matter will be reported to PAGCOR as required by law.
12 Cross-Border Data Transfers
The fachai3 platform is operated for and targeted at Filipino players, and the primary processing of personal data occurs within the Philippines. However, certain technology service providers — such as cloud infrastructure partners — may process data on servers located outside the Philippines.
Where personal data is transferred outside the Philippines, fachai3 ensures that appropriate safeguards are in place to protect the data to a standard equivalent to that required under RA 10173. Such safeguards include contractual data protection clauses with all third-party processors and, where applicable, transfers only to jurisdictions with adequate data protection laws.
fachai3 does not transfer personal data to jurisdictions where doing so would compromise the protections afforded to you under Philippine law.
13 Third-Party Services
The fachai3 platform integrates with certain third-party services to deliver its full functionality, including payment gateways (GCash, PayMaya, BPI, BDO, Metrobank), game content providers, and KYC verification tools. These third parties operate their own privacy policies and data handling practices.
fachai3 carefully vets all third-party service providers before integration and requires them to adhere to data protection standards consistent with RA 10173 through contractual data processing agreements. However, once data is transmitted to a third-party provider for processing, that provider's own privacy policy governs its handling of that data.
fachai3 is not responsible for the privacy practices of third-party payment platforms. We recommend reviewing the privacy policies of GCash, PayMaya, and your bank before using their services in connection with your fachai3 account.
14 Policy Amendments
fachai3 reserves the right to update or revise this Privacy Policy at any time to reflect changes in applicable law, PAGCOR regulations, platform features, or our internal data handling practices. The effective date at the top of this document will be updated whenever a change is made.
Where changes are material — meaning they substantively affect how we collect, use, or share your personal data — we will provide prior notice to registered players via the email address on file or through a prominent in-platform notification before the updated Policy takes effect.
Your continued use of the fachai3 platform after the effective date of any amendment constitutes your acceptance of the revised Privacy Policy. If you do not agree with the changes, you should discontinue use of the platform and contact us to request account closure.
